FREQUENTLY ASKED QUESTIONS

EXPERIENCE. COMPASSION. PROVEN RESULTS.

I was in a motorcycle accident where a car turned left in front of me. In Florida, who would be at fault?

Motorcyclists are more vulnerable than other motorists on the road. In many Florida motorcycle accidents, motorcyclists are victims of a driver negligence and/or failure to respect the rights of motorcyclists.

Florida traffic law states that all motorists who intend to make a left turn must yield to all traffic approaching. This means that in most Florida motorcycle accidents where a vehicle turned left in front of a motorcycle, the driver of the car would be liable for the accident.

There are a few exceptions that may apply to this rule about yielding, but they depend on the particular circumstances surrounding the Florida motorcycle accident. For example, if the motorcycle going straight ahead was speeding or ran a red light, their actions were likely the leading cause of the accident.

Car or truck drivers may also be at fault for a Florida motorcycle accident if they swerve in front of a motorcyclist. Visual recognition is a huge factor in many Florida motorcycle accidents. Drivers are also usually at fault if they hit a motorcyclist while they are changing lanes if they fail to notice the motorcycle sharing the road with them.
